Minutes of the Regularly Scheduled Council Meeting
July 22, 2002
City Hall Annex Building, 186 Branham Way
6:30 p.m.
Mayor Ed Hilbert called the meeting to order at 6:30 p.m. with the following
members present: Sam Beichler, Ralph Lutes, Frank Sullivan and Brent Wheeler.
Sid Griffin was Absent.
The City Clerk, City Attorney, Utility Superintendent, City Engineer and City
Treasurer were also present.
The invocation was given by Mark Wilson of Mt. Washington United Methodist
Church.
Brent Wheeler made a motion to accept the minutes of the July 8, 2002 meeting as
read. Sam Beichler seconded the motion. Motion passed. (Unan.)
Barry Armstrong arrived at 6:37 p.m.
Sam Beichler made a motion to accept the minutes of the July 11, 2002 special
meeting as read. Frank Sullivan seconded the motion. Motion passed. (Unan.)
Kim Fell, City Treasurer, gave the treasurers report. Frank Sullivan made a
motion to accept the treasurers report. Brent Wheeler seconded the motion.
Motion passed. (Unan.)
The second reading was conducted on Ordinance 2002-15 regarding annexation of
Bethel United Methodist Church property of 5.7363 acres on Hwy 44. Brent Wheeler
made a motion to adopt Ordinance 2002-15. Ralph Lutes seconded the motion.
Motion passed. (Unan.)
There was some discussion on the ordinance relating to residential building
permit fees. One change discussed was a minimum fee of $30.00 for the initial
1,000 square feet and .03 cents per square feet above 1,000. Also discussed was
changing Section F relating to whether a dumpster is required at a construction
site. The change suggested was rather than City Administrator, Mayor, City
Clerk, and Code Enforcement shall determine whether or not a dumpster is
required. These changes will be brought back before a first reading.
Barry Armstrong made a motion to add the word exterior to Section A of
requirements for a building permit on enlargements that affect the (exterior)
bearing walls of any building. Frank Sullivan seconded the motion. Motion
carried 4-1. Brent Wheeler voting no.
Brent Wheeler made a motion to approve a substitute protective device for a
swimming pool at 246 Meadowview Drive. The pool is 53 inches in height which
surpasses the 48 inch enclosure and latch requirement as well as a locking
ladder with a height of 73 inches from the ground. Sam Beichler seconded the
motion. Motion passed. (Unan.)
Earl Barr, of 201 Beechtree, addressed the Council in regard to mud coming on to
his property and into his garage from the development behind him. He stated
bales of hay would stop the mud. He asked if the City could do anything. Mr.
Fick, Utility Superintendent, stated he will get with the developer about it.
Sam Beichler made a motion to enter into executive session at 7:15 p.m. to
discuss property. Ralph Lutes seconded the motion. Motion passed. (Unan.)
Ralph Lutes made a motion to reconvene open session at 8:03 p.m. Sam Beichler
seconded the motion. Motion passed. (Unan.)
There was no action taken as a result of executive session.
There being no further business before the Council, Brent Wheeler made a motion
to adjourn the meeting. Frank Sullivan seconded the motion. Motion passed. (Unan.)
The meeting was adjourned at 8:03 p.m.
