Minutes of the Regularly Scheduled Council Meeting
May 14, 2001
City Hall Annex Building, 186 Branham Way
6:30 p.m.
Mayor Ed Hilbert called the meeting to order at 6:30 p.m. with the following
members present: Sam Beichler, Sid Griffin, Ralph Lutes, Frank Sullivan, and
Brent Wheeler. Barry Armstrong arrived at 6:40 p.m.
The City Attorney and City Clerk were also present. Ronnie Fick, Utility
Superintendent, arrived at 6:40 p.m.
The invocation was given by Mark Wilson.
Frank Sullivan made a motion to accept the minutes of the April 23, 2001 meeting
as read. Sid Griffin seconded the motion. Motion passed. (Unan.)
Gale Park gave the Clerks report.
Chrystal Myers, of Career Resources, gave a presentation to the Council about
Career Resources.
Dennis McMahan, of 201 Barbara Sue Lane, addressed the Council about drainage
problems coming from the Autumn Glen subdivision. Utility Superintendent, Ronnie
Fick, will contact the developer.
Steve Vaughn, of 317 West Street, addressed the Council about the City's Park
gate being locked. The City has begun locking the gate and failed to unlock it
that day. Mr. Vaughn was asked to call City Hall if he found it locked again
during open Park hours.
Roger Mullins, of 187 Jasper Lane, addressed the Council in regard to the fence
around the City Park. The fence was put up along his property line and he was
opposed to the fence. He asked if the Council would consider an opening into the
park. It was unknown to the City and Council that he had adjoining property to
the park. It was thought to be part of the Settles property and due to the vote
at the last Council meeting a fence was completed to the Settles property. The
Council agreed to meet at the park to view the fence situation before making any
further decisions.
Frank Sullivan made a motion to sponsor the next years Spring Festival in the
amount of $1,500. Sam Beichler seconded the motion. Motion passed. (Unan.)
Barry Armstrong made a motion to cancel the Council meeting on May 28th due to
the Memorial Holiday and not to reschedule it unless needed. Ralph Lutes
seconded the motion. Motion passed. (Unan.)
Sam Beichler made a motion to enter into executive session at 7:18 p.m. to
discuss personnel, property, and litigation and also to invite Mr. Robert
Stopher into executive session. Ralph Lutes seconded the motion. Motion passed.

Frank Sullivan made a motion to reconvene open session at 8:40 p.m. Sam Beichler
seconded the motion. Motion passed. (Unan.)
Barry Armstrong made a motion to follow the recommendation of Mr. Robert Stopher,
Council representing the City's insurance carrier, to authorize Mr. Stopher and
Mr. Wantland, City Attorney, to conclude litigation with a former employee based
solely on economic reasons as well as being to the City's advantage to do so.
Ralph Lutes seconded the motion. Motion passed. (Unan.)
Sam Beichler made a motion to authorize the Mayor to execute any documents the
City needs to secure a line of credit up to $1,000,000. with the Peoples Bank of
Mt. Washington for the purpose of acquiring property and easements and other
items related to the City's Business Centre. Sid Griffin seconded the motion.
Motion passed. 5-0 Barry Armstrong abstaining.
There being no further business before the Council, Frank Sullivan made a motion
to adjourn the meeting. Brent Wheeler seconded the motion. Motion passed. (Unan.)
